Employment-Based Immigration: first Preference EB-1

You may be qualified for an employment-based, first-preference visa if you are an alien of extraordinary ability, are an exceptional teacher or researcher, or are a specific international executive or supervisor. Each occupational classification has specific requirements that should be fulfilled:

Your petitioning company must be a U.S. employer and intend to utilize you in a managerial or executive capability. The petitioner must have been doing organization in the U.S. for at least 1 year, as a legal entity with a qualifying relationship to the entity that utilized you abroad in a supervisory or executive capability.

No labor certification is required.

* Criteria for Demonstrating Extraordinary Ability

In order to demonstrate you have sustained national or global acclaim which your achievements have been acknowledged in your field of expertise, you must either include evidence of a one-time achievement (significant internationally-recognized award) or 3 of the 10 noted requirements listed below (or similar evidence if any of the criteria do not readily use):

– Evidence of invoice of lesser nationally or globally acknowledged prizes or awards for quality

– Evidence of your membership in associations in the field which demand outstanding of their members

– Evidence of published product about you in expert or significant trade publications or other significant media

– Evidence that you have actually been asked to evaluate the work of others, either separately or on a panel

– Evidence of your initial scientific, academic, artistic, athletic, or business-related contributions of significant significance to the field

– Evidence of your authorship of scholarly posts in expert or employment major trade publications or other major media

– Evidence that your work has been displayed at artistic exhibits or showcases

– Evidence of your efficiency of a leading or employment critical role in prominent companies

– Evidence that you command employment a high salary or other significantly high remuneration in relation to others in the field

– Evidence of your commercial successes in the carrying out arts

** Examples of Documentary Evidence That a Person is an Impressive Professor or Researcher

In order to show you are an exceptional teacher or scientist, employment you should consist of evidence of 2 of the 6 listed requirements listed below (or comparable proof if any of the requirements do not easily apply):

– Evidence of invoice of major rewards or awards for impressive accomplishment

Evidence of membership in associations that require their members to demonstrate outstanding accomplishment

– Evidence of released product in professional publications composed by others about the alien’s work in the academic field

– Evidence of participation, either on a panel or separately, as a judge of the work of others in the exact same or allied academic field

– Evidence of original clinical or academic research study contributions in the field

– Evidence of authorship of academic books or articles (in scholarly journals with international circulation) in the field

Application Process

Extraordinary Ability: You may look for yourself by filing a Type I-140, Petition for Alien Worker.

Outstanding Professors and Researchers: Your U.S. employer should file a Type I-140, Petition for Alien Worker. As part of the application procedure, your company must have the ability to demonstrate a continuing ability to pay the used wage since the priority date. Your company might use a yearly report, federal tax return, or employment audited financial declaration to demonstrate a continuing ability to pay your wage.

Multinational Manager or Executive: Your U.S. company must file USCIS Form I-140, employment Petition for Alien Worker. As part of the application process, your company needs to be able to demonstrate a continuing capability to pay the provided wage as of the priority date. Your employer might use an annual report, federal tax return, or audited financial statement to show a continuing capability to pay your wage.
